Storage Punters - User Agreement

Welcome to Storage Punters! This User Agreement outlines the terms governing your use of Storage Punters ("Platform"), an online marketplace that facilitates the auctioning of storage unit contents by sellers ("Sellers") to buyers ("Bidders"). By registering and using the Platform, you confirm your acceptance of these terms.

1. Key Definitions

"Services" – The digital platform provided by Storage Punters that enables auctions for storage unit contents.
"Sellers" – Individuals or businesses listing storage unit contents for auction.
"Bidders" – Registered users participating in auctions by placing bids.
"Platform" – The Storage Punters website located at www.storagepunters.com
"Transaction" – The process of bidding, winning an auction, and acquiring the contents of a storage unit.
"User" – Any individual accessing the Platform as a Seller, Bidder, or visitor.

2. General Use Guidelines

2.1 Eligibility
Users must be at least 18 years of age.
By using the Platform, you confirm that you are legally able to enter into binding agreements.
2.2 Modifications
These terms may be updated periodically.
Any changes take effect once published on the Platform.
2.3 Account Registration
Users must maintain the confidentiality of their account credentials.
Storage Punters is not responsible for unauthorized access to accounts.
2.4 Additional Agreements
Sellers may impose additional terms on their individual auctions, which Buyers agree to by bidding.
In case of a conflict, the Seller’s specific terms will apply in addition to these terms.

3. Auction Participation Rules

3.1 Storage Punters' Role
Storage Punters serves as an auction marketplace and does not own, manage, or transfer ownership of any items listed.
3.2 Bidding and Winning
Bids must be placed in compliance with the auction rules set by the Seller.
The highest bid at auction close is the winning bid.
Bids placed cannot be revoked.
If a bid is placed within the final minute of an auction, the auction time will automatically extend by two minutes.
3.3 Payments
Successful bidders must complete payment within the timeframe specified in the auction details.
Payments are processed securely through third-party providers.
Failure to complete payment may result in the auction being re-listed or awarded to the next highest bidder.
3.4 Item Collection
Winning bidders must remove their purchased items within the timeframe specified by the Seller (typically 72 hours).
Sellers may require a cleanup deposit (typically $200), which is refundable if the unit is left clean and empty.
Failure to collect items within the specified timeframe may result in forfeiture and additional disposal fees.
3.5 Personal Items Handling
Any personal documents or sensitive items (e.g., photos, legal paperwork) discovered in a unit should be returned to the facility or disposed of appropriately.
3.6 Disputes
Any disputes between Buyers and Sellers must be handled directly between the parties.
Storage Punters is not responsible for resolving disputes regarding the quality or condition of auctioned items.

4. Seller Obligations

4.1 Auction Listings
Sellers must provide accurate descriptions of unit contents.
Only legally permissible items may be listed.
4.2 Unit Access
Sellers are responsible for granting reasonable access to winning bidders for item collection.
4.3 Auction Cancellations
Sellers retain the right to withdraw auctions before their completion.

5. Prohibited Activities

5.1 Fraud and Misuse
False bidding, self-bidding (shill bidding), or misrepresentation is prohibited.
Any attempt to manipulate the bidding process will result in account suspension.
5.2 Restricted Goods
The sale of prohibited items is strictly forbidden, including but not limited to:
Firearms and ammunition
Explosives and hazardous materials
Controlled substances or illegal drugs
Alcohol (unless legally permitted)
Stolen property
Illegal or counterfeit goods
5.3 Website Misuse
Unauthorized access, data scraping, or interference with platform functionality is not permitted.
Automated bots, scrapers, or tools that interfere with the bidding process are strictly prohibited.

6. Limitation of Liability

Storage Punters does not guarantee the condition, authenticity, or legality of auctioned items.
The Platform is not liable for disputes arising between Buyers and Sellers.
Auctions are conducted as-is, where-is, and all sales are final.
Storage Punters is not responsible for technical disruptions affecting auction participation.

7. Account Suspension and Termination

Storage Punters reserves the right to suspend or terminate accounts that violate these terms.
Accounts engaged in fraudulent or disruptive activities may be permanently restricted.
Any attempt to circumvent platform policies will result in immediate suspension.

8. Governing Laws

This Agreement is governed by the laws of the state where the auction occurs.
Disputes shall be resolved under the applicable jurisdiction.
