Storage Punters - User Agreement

Welcome to Storage Punters! This User Agreement outlines the terms governing your use of Storage Punters ("Platform"), an online marketplace that facilitates the auctioning of storage unit contents by sellers ("Sellers") to buyers ("Bidders"). By registering and using the Platform, you confirm your acceptance of these terms.

1. Key Definitions

  • Services – The digital platform provided by Storage Punters that enables auctions for storage unit contents.
  • Sellers – Individuals or businesses listing storage unit contents for auction.
  • Bidders – Registered users participating in auctions by placing bids.
  • Platform – The Storage Punters website located at www.storagepunters.com
  • Transaction – The process of bidding, winning an auction, and acquiring the contents of a storage unit.
  • User – Any individual accessing the Platform as a Seller, Bidder, or visitor.

Storage Punters acts as a facilitator for the sale between the Seller and the Bidder. We are not the owner of the items, nor are we a party to the final sale agreement. Our role is solely to provide the online platform for this transaction.

2. General Use Guidelines

2.1 Eligibility: Users must be at least 18 years of age. By using the Platform, you confirm that you are legally able to enter into binding agreements.

2.2 Modifications: These terms may be updated periodically. Any changes take effect once published on the Platform.

2.3 Account Registration: Users must maintain the confidentiality of their account credentials. Storage Punters is not responsible for unauthorised access to accounts.

2.4 Additional Agreements: Sellers may impose additional terms on their individual auctions, which Bidders agree to by bidding. In case of a conflict, the Seller’s specific terms will apply in addition to these terms.

3. Auction Participation Rules

3.1 Bidding and Winning: Bids must be placed in compliance with the auction rules set by the Seller. The highest bid at auction close is the winning bid. Bids placed cannot be revoked. If a bid is placed within the final minute of an auction, the auction time will automatically extend by two minutes.

3.2 Payments: Successful bidders must complete payment within the timeframe specified in the auction details. Payments are processed securely through third-party providers. Failure to complete payment may result in the auction being re-listed or awarded to the next highest bidder.

3.3 Payment Failure: If a winning Bidder's payment fails for any reason, they are considered to be in breach of contract. The Seller may re-list the unit or offer it to the next highest Bidder. The defaulting Bidder will be liable for all costs incurred, including administrative, cleaning, and disposal fees. The Bidder waives any claims against Storage Punters or the Seller related to the disposal of these items.

3.4 Item Collection: Winning bidders must remove their purchased items within the timeframe specified by the Seller (typically 72 hours). Sellers may require a cleanup deposit (typically $200), refundable if the unit is left clean and empty. Failure to collect items may result in forfeiture and additional disposal fees.

3.5 Personal Items Handling: Any personal documents or sensitive items (e.g., photos, legal paperwork) discovered should be returned to the facility. Bidders agree to handle and return such items responsibly. Storage Punters and the Seller are not liable for any such items after the sale is finalised.

3.6 Disputes: Disputes between Bidders and Sellers must be handled directly. Storage Punters is not responsible for resolving disputes about item quality or condition.

3.7 Data Security: All financial details are handled by PCI DSS-compliant payment processors. Storage Punters does not store credit card information and uses industry-standard encryption for transactions.

4. Seller Obligations

4.1 Auction Listings: Sellers must provide accurate descriptions and list only legally permissible items.

4.2 Unit Access: Sellers must provide reasonable access for item collection.

4.3 Auction Cancellations: Sellers may cancel auctions before they conclude.

5. Prohibited Activities

5.1 Fraud and Misuse: False bidding, self-bidding (shill bidding), or manipulation is prohibited. Suspected fraud or misuse may result in account suspension and bidding restrictions during security review.

5.2 Restricted Goods: The following are prohibited from sale:

  • Firearms and ammunition
  • Explosives and hazardous materials
  • Controlled substances or illegal drugs
  • Alcohol (unless legally permitted)
  • Stolen property
  • Illegal or counterfeit goods

5.3 Website Misuse: Unauthorized access, scraping, or disruption of platform functionality is forbidden. Automated tools that interfere with bidding are strictly prohibited.

6. Limitation of Liability

Storage Punters does not guarantee the condition, authenticity, or legality of auctioned items. We are not liable for disputes between Bidders and Sellers. Users agree to indemnify Storage Punters against claims or damages arising from their interactions or use of the Platform. All auctions are as-is, where-is, and all sales are final. We are not responsible for technical disruptions.

7. Account Suspension and Termination

We reserve the right to suspend or terminate accounts that violate these terms. Fraudulent or disruptive accounts may be permanently restricted. Attempts to bypass policies result in immediate suspension.

8. Governing Laws

This Agreement is governed by the laws of the State or Territory in which the auction is located. Disputes will be handled by the courts in that jurisdiction.
